EB-3 Indians face a greater problem than EB-2 Indians and all of Chinese, due to their bigger share in the H1B pie.
EB-3 P.D cut-off was SEP 1996 as of JUL 99, and it was current between Aug 1999, thru Mar 2000. During this time, whoever got I-140 approval would have filed the 485. The number of applications with P.Ds between OCT 96 thru the current cut-off FEB 8, 1997 is suspected to be large and yet to be processed by INS. As INS wades thru these applications, P.D may either retrogress and stall or move forward only slowly.
But for the new fiscal year starting OCT 1, 2000 the prospect of good forward movement is large, but only to retrogress later.
If it is any consolation, it will *NOT* retrogress beyond OCT or NOV 1996. Next years quota of about 2800 Visas., should be enough to fulfil applicants upto atleast End of 1996 ( let\'s hope!!!) .
For EB-2 it has it\'s own quota of 2800 + unused EB-1s which must be atleast about 2000 for the new fiscal year . I cannot envision more than 800 extrodinary Indians within a year. Plus not many companies agree to do EB-2 for every-one , for fear of INS Audit. So the prospect is better.
