Aug 2001 case no RFE yet

I dont know if I am the only person with ND of Aug 2001. I havent received an RFE either. I called the 1-800 number and they said I had to wait for one week before tthey can enquire. In the intrim I contacted the senator and their office had promptly replied. They had made an enquiry on friday by email. I hope to receive some information this week. Is any one in the same boat as me?

When did you do your FP? you may get approved without RFE.

That's what we are hoping for.

Hey 2001 Buddies....

I am not a hater nor an instigator, but why is TSC approving so many 2002 cases? I am happy for all the people being approved but I feel so disappointed and discriminated against.

It's like we 2001 filer do not exist.....

One of the memebers in the NSC 485 processing, called and complained to his senetorthat he was being discriminated. He printed a list of LIN numbers that had ND in 2002 and basically tried to justify that his case needs to be taken care of and sure enough he got his AD. It may be something to consider.

I got approved on 4-8-2004. I just looked at the web site now.

RD 03-08-2002
ND 03-28-2002
2nd FP 12-10-2003

I did some aggressive actions to make this happen. All I could say at this moment is PRESSURE WORKS.

No RFE.

Oct-12-2000. Applied Labor (RIR, NJ) , RFE from NY Federal Labor. Approved on JUNE-2001.

JUN-2001 Applied I-140 (Vermont). Approved on JAN-2002 with a RFE.

MAR-8-2002. Applied for I-485 (NSC).

2003 MAY, 2003 NOV. Contacted CO congressman Tom Tancredo. No luck.

MAR-2004. Contacted Senator Dian Feinstein. Her office asked me to contact CO Senator's office with all the details.

16-MAR-2004 Sent Employment letter from my company with out any RFE.

22-MAR-2004 Applied for new EAD, AP. ( Not approved yet).

22-MAR-2004 Met CO Senator Wayne Allard's immigration staff.

Here are the details.

I asked the 3 questions in my letter?
a). Is my case assigned to IIO?
b). Has my name gone FBI to background check?
c). Have we missed any RFE's due to my lawyer's change of address?

I enclosed an addendum to the letter. I convinced the senator's aide that I'm clearly discriminated by NSC as there are several cases approved for APR/MAY-2002. I documented this by printing approved cases from CIS web site. I also explained her how this delay is effecting my personal life(financial and other). She promised me, she will do whatever possible with in her limits. Today I saw the good news after 3.5 years of painful wait.

My suggestions for fellow travelers.
1). Don't wait for RFE, Sent the Employment letter.
2). Meet your local Senator's staff in person and tell(exaggerate) your story. Provide
Sufficient documentation to support your story.

I think this WORKS. Thank you all for your support and encouragement.

Days from the date of this receipt for us to process this type of cases.” My receipt
Notice is dated 08-MAR-2002. So it is well past 2 years.

Nebraska has processed Large Number of cases filed in APR-2002 and MAY-2002
Ignoring the cases filed before, in my case MAR-2002.

Hi reliance

My RD is 08/2002. And i have changed my job.
Can i send my employer letter to NSC without waiting for RFE.

Can you provide the emp letter format that you have used?
and what other documents we need to send to NSC, like copy of I-485, I-140 etc..

It is amazing that you have done so much to make this happen! Most of us are just anxiously waiting, and uselessly complaining.

I am from Colorado as well. Could please post detailed contact information of senators and congressman, such as telephone number, email address, office phone number , etc.? If possible, how you were treated when making these contact with these people's staff member?

Definitely you had a lucky day. Many guys with Oct/Nov 2001 RD/ND have contacted their local senators but the front office did not really encorage them, since CIS had a stupid date 09-30-2001.

I doubt sending an employment letter without RFE has any impact on the processing. In fact without the RFE, CIS has no way of tying the employment letter to an I-485 file which has not been assigned to a IIO.

I called the above number asked for 10M appointment with the immigration aide. I told her, I have a serious issue with my I-485 application. I did not give her the details on phone. I presented her rupnet.com statistics and printouts of approved cases filed later than mine. I convinced her that I'm discriminated. She told me about the current processing date and all that crap. She also told the standard INS reply that every case is diffrent. I told her all EB categories are same, there can't be any difference.

She was reasonable and spent almost 20 minutes with me.

I hope all of your wait will be over soon.
