my Aug '03 I-140 is not approved yet...I called my lawyer she says she has sent a letter to USCIS to check on the status but she said she is not expecting any response from them because they have never responded them in the past.


My lawyer is not willing to call them over the phone she is saying it takes about 45 mins to get them on the line.

Any suggestions...Do you think i call then they will give me any good info.

I called USCIS few mins back. The same stupid response i got was your attorney or employer should be with you while checking for 140 pending cases.

They said you have 15 seconds if you want me to put on hold and get them on the line after 15 secs phone will disconnet.

My employer and attorny doesnt have time to be on phone for 45 mins.

Guys I am stuck. DOnt know what to do..

I donot recommend this but, if u are desperate

Have your Receipt number, employers phone number and Tax Id ready. Call USCIS and tell them that you are the HR with your employer and would like to start a case referral. Give the details they want and you will be all set.

I am sure it is not going to make any difference even if your lawyer calls USCIS. They probably going to get the same answer.

My I-140's RD was 06/30/03 and I contacted the senator's office. They got back to me promptly and said that since my previous I-140 was rejected and this is my second one, it is taking longer time. I lost hope and within 2 weeks I got a FP notice. Atleast something happened on case after sleeping for over a year.

So I would strongly suggest to contact senator.
 
What worked for me was my lawyer filing two inquiries one after the other. I think they were filed one month apart. My case was approved shortly after the second inquiry. I cannot be sure if the inquiries triggered the approval or they were about to do it anyway. I think inquiries are the official way to bring attention to your case. Hope this helps.
