Attorney Change, can the old attorney screw up?

Hi,

I filed my labor,140 and 485 through my old company's attorney. the company was supposed to pay for the GC process but kept postponing the payment. the attorney has been sending all his bills to me. I have spoken several times to the company and they kept evading the issue. They asked me to pay and said they will reimburse it later. I refused to do so and the issue was hanging in mid air. Now, I changed my employer from the 1st of July and my 140 was approved yesterday. Now, I want to change my attorney (my current company's). If I sign G-28, is the old attorney responsible for giving all my papers to the new one? Can he create any problems for the pending amount?

I am soooooooo confused.

Your old attorney needs to handover all your related information to the new attorney as per G28.

But, my recommendation is that you pay off your amount to the old lawyer, as he might put a case against you for having not paid on time along with the interest, or even not handover the documents to your new lawyer stating him that a balance is still on your account.

This would place a bad picture on yourself for not paying the lawyer properly and even the new lawyer would be hesitant to handle your case hoping of the mispayment which he might need to handle in future.

Your old lawyer has to hand over the document once you fill over G-28. It cannot be denied.

If you are responsible for making payments - any contract etc exist which states so - then he can take you to court - it is criminal offence. If there is no such contract - he can't do anything.
