Attended the interview but did not get visas

My family has attended the interview in Montreal on April 4, 2013 when our kids did not have all vaccinations. We've got the vaccinations and sent the medical exams along with the passports in May. We have not received any word from the embassy since then. Has anyone heard about a similar situation? Is there a risk of not getting the immigrant visas because the numbers have been exhausted?

Can I transfer my Cancelled H1B ?

Hi Sir,

I am new to this forum I just want to know if there is any posibility to transfer cancelled h1b visa to other employer.

Here is my case,

Due to some personal reasons I came out from A organization and joined to some B organization. I never travelled to USA and I just have recepit number.

Please let me know what can i do in this case, I dont even know the status of my h1b.

an employer cannot cancel visa he can only withdraw the petition

employer B has to file a petition before H1B visa expires.
It illegal for employees to make changes in passports by marking any type of visa as "cancelled"

Sir,

But my doubt is
Employer A can withdraw the petition after it's get approved?
Assume Employer A cancelled the petition. can we transfer the cancelled petition to employer B?
I don't have any document about petition approved other than receipt number. In this case without any document can employer B do a transfer processes?

Please help on this.

Yes, employer A can tell the authorities that you are no longer employed with them and that would end that petition. H1B cannot be transferred to other employers; the new employer has to file a totally new petition. If a new petition is filed it is understood that you have no intention of joining the previous employer or the previous employer has no intention of hiring you.

Sorry to hear that. You can check the status of your visa application here: https://ceac.state.gov/CEACStatTracker/Status.aspx?eQs=o/iS8zDpeAKjMWCuebHqOw==

You should enter your number like here (2013EU100) instead of this (2013EU00000100). I hope this helps.

This is correct. That old H-1B is only valid as long as you work for the sponsoring employer. Employers are required to notify USCIS when they terminate an H-1B employee, so the petition can be revoked. You have to assume that the old H-1B has been cancelled.

To file a new petition any proof of documents required about earlier petition? I have recepit no only, I don't have I797.
To file a new petition can i go with new cap or can i use the existing cap?

You can only use the existing cap if you had a previous approved H1-B that was included within the cap. That is one advantage that you would have if your first H1-B was complted. Without having that, and since the H1-B cap has been met for this year, you couldn't now apply for a new H1-B until April 1 next year and that couldn't start until October 2014. Many people who wanted H1-B visas lost out in a lottery this year, so getting the chance for a visa isn't for sure either.

Hi, I need a small info from experts, H1B processes is initiated for me, but my name is spelled wrong in MCA certificates it's differ to my passport name. It will cause any issue in my h1b processes?.

I guess it would depend how bad the mis-spelling and what proof you could show to explain that they were yours.

So, if the name is supposed to be "John Smithson" and they spelled it "John Smithsin" and you have other evidence that shows the certificates are yours, I would say no problem. If however the certificates are in the name of "John Jones" and you have nothing to connect you to the certificates I would say that is a problem.

if the misspelled name ends up on approval notice it stays like that (no new approval notice) even though USCIS has the corrected version and even though the note(s) on correction are sent out in due time (always prior the interview)

from no expert, just an opinion
