Hello All. I have finally got an interview date in Nov. My case has taken quite a while to get an interview. Here are the details :

Filed on Sep 9th 2000
Receipt OCt 30 2000
Assessment that interview required FEB 2001
File transfer Dec 2001
Interview notification Sep 2002.

Could gurus help me by sharing their experiences at the Interview. What kinf of questions can I expect and what is the dress code. I have to go to Detroit Consulate with my wife.

I would really appreciate a response from you.

Take all your orignal passport for you and if any depenent, past and current EXp letters, orignal education Degree Certificates, recent 2-3 month bank statements, if married orignal marriage certificate and all that what is written at the back of interview letter
Questions will be mostly:
What you were doing in US
Where you want to go in Canada
will see each orignal paper few questions related to your accupation,.
have you tried to search for job in Canada? if you send resume to some company they will only reply to apply when land show the print outs.

Can we wait 3 years outside Canada and then enter.

***The day you get your Landing permit in hand you can any time go for landing in Canada and become PR of Canada. You should enter Canada before the Expiry date of your Landing permit.

Can we wait 3 years outside Canada and then enter.

***ONLY AFTER LANDING in Canada you can stay our of Canada for 3 years in any 5 years. First you have to land and become Permanent resident at Canada Airport or through Border post, your landing document will have expiry date on it so you should go to Canada for landing before that and normaly that date will be 12 months from your Medical date. wait for Landing papers then only plan.

1) Can I delay my medical to after the interview if possible. On my interview letter it says that please do your medicals as soon as possible.

2) If I can do that then how long can I delay it for.

3) Can this have a negative affect on my case during interview ?

4) The dillemma I am facing is that I dont have an H1 stamp on my passport. So I am wondering if I go to Canada on an Advance Parole and become Permanent Residence then Could I be stopped from re entering the US or not ?

you should not delay the medical for long after the date you recieved your medical notice you should do it with in 60 days it is not a law but better do it becase when you do the medicals the doctor normaly sends your results to Ottawa and then Ottawa takes about 30 to 60 days to send them to the Conulate where your file is.. If you wish then do the medical before your Interview date and if asked at time of Interview about medicals inform you have done it few days back.

*** it will delay your LP and if you prolong more you may recieve a letter that if you do not submit medicals by particular date your application will be abondoned, there is nothing wrong doing medicals, do it fast , I know your concern, even if you do medicals in next week you will get your LP only after 4-5 months. some have not recieved after 6 months, dont delay.

If you have EAD anmd AP you can enter USA with out any problems ,US has nothing to do with your becoming Canada PR.

If you are not using EAD for work and still have time on your H1B and your Visa Sticker has not expired more than 1 year you can also REVALIDATE your H1B in US and you will get stamp of valid H1b from DEPARTMENT but for that you should have previous expired H1B stamp on your passport.
If you are using EAD and you filled up I-9 form with employer that you are using EAD then you have to enter using AP from Canada or from any other country to reenter US, AP is alternative of Visa only that is for reentry purpose only.



Why you are worried? go and do the medical, how to enter after getting Canada PR you should not be concerned at this time.

My interview in LA

At last, I also got Interview call for Perm Residency. The interview is in Nov 1st week in Los Angeles.

Please help me for the following questions.

1.In the interview letter, nothing is mentioned about medicals.
But when my case is transferred from Buffelo to Los Angeles office, they sent the medical proformas. Do I need to take medicals along with me to the interview ?

2.I live in California. Do I need to take Police Certificate from FBI or California State(Sacremento office) or both of them.
This is a time taking process and in case I donot get this certificates in time, what happens in the interview ?

3. I am an Indian and I hope I need not get any clearence from India.


I appreciate what ever the info you provide in this matter.
Are there any who got interview in LA ?

The reason why I want to delay my medicals is because i am just about to file for I-485. Maybe in next 30 days at Nebraska Center (which is taking 13 months to process I-485). Also my interview is within the next 2 months. Since you told me that we get 1 year from date of medicals on the landing papers I am hoping that by delaying the medicals to about 2 months after the interview (which is in Nov) it gives me a window of 14 months to get my approval notice for I-485. So I dont mind at all if my landing date deadline gets delayed.

So in that case I dont have to take risk and leave the US on I-485. Once I get my US Green Card then I dont need the Canadian GreenCard as I have a decent job here and am well settled here.

But I am confused about the following things:

1) Is that certain that we have a deadline for 1 year after date of medicals to land in Canada. (where can I read more about this rule).

2)While coming back If the INS officials see the Canadian Permanent Residence stamped on my passport then could they stop me while re entering even on Advance Parole. Because I believe we can just keep 1 permanent residency which is either US or Canadian. I am a citizen of India. I am planning to drive to Canada.

3) I dont have any H1-b visa sticker stamped at all on my passport. I just have the approval notice for H1-b which is valid for Dec 2004 (since I had a change of status from J1 to H1 and never left after that). Could not having a stamp complicate things further while re entering on Advance Parole ?

*** There is no Risk going out of Canada if you have filed I-485, you should have AP to enter and if you still have H1B and I-94 Valid and you do not use EAD then you can enter on H1b visa.

YES it is a LAW that Landing permit will be issued for one year from the date of your Medicals and if your Passport is not Valid for one year then LP will be issued till the Expiry date on your Passport, for the law read Immigration law and you may find Instruction on your Forms you filled and you will be told about this when you go for Interview, The Landing date can not be extended it is also law, for more info read on Canada immigration lawyers web site

***INS has nothing to do with your Canada Immigration they want your immigration status or Visa or Ap for entry to US. Many have landed and came back you are not the only case who is doing to do this first time.

Because I believe we can just keep 1 permanent residency which is either US or Canadian. I am a citizen of India. I am planning to drive to Canada.
** First get the landing paper then think you wand to go by air or by Driving...

You will not be able to get H1B i in US if you changed from J to H1b, you will or have to use AP, if in the mean time you Visit India try to get H1B Stamp if you are not using EAD if using EAD then H1B visa is not needed only AP will work but better to keep the I-485 filing reciept with you.

why are you worried for Canada info now, better post when you get LP for Canada, still you have to clear your Interview, Medicals and Background check.

The Medical Proforms yo have to take to DMP for Medicals, he/she will do the medical and send it to Ottawa, you do not have to take any medical paper or info for Interview. You should take these Medical forms to DMP in your Area and if you have changed address or your address is not correct on Forms or you changed address then also you can correct the address before DMP

This is a time taking process and in case I donot get this certificates in time, what happens in the interview ?

You have to Send FBI clearence only. If you send FBI card Fingerprinting card to FBI then they will stamp it NO ARREST RECORD at back of the Card, then take that FBI card at the time of Interview, because you have Interview first week of November and FBI takes 4-8 weeks to send your card back to you, so better Submit FBI clearence at time of Interview, Have you not provided FBI Clearence with your application?

3. I am an Indian and I hope I need not get any clearence from India.
No yo do not need any clearence from India becase they know how reliable is the info from India they check your India info through Canada security department.

Thanks a lotAvataar. I am sure those suggestions would help me a lot. I guess its too earliy but I was just making sure that if there is anything I can do right now to make it easier for me after 1 year.

I guess the only choice I have is to go to India and get a stamp before I-485. I probly wont be able to do that in such a short period of time due to time constraints and very busy job in my company. SO we will wat and see what happens.

Also I didnt know that landing papers are issued only till the day my passport expired. Mine would expire on Mar 2003.

Should I renew my passport before going to my interview. Because we can do that 6 months before passport expires. I was thinking that once the passport expires then I can just take the newly renewed passport since it would have the same passport number on it.
Could this also turn out to be an issue.

Man. The problems just dont end at all !!!!!!!!!!!!!!
 
Your Interview is within the next 2 months and your passport is going to Expire in March 2003, will you be able to renew your passport before Interview date? If possible try to get new Passport copy and at the time of Interview show your Old and New Passport.

If you do not get new Passport before Interview, you should immediately inform the Visa office and provide your new passport copy before they issue you landing paper, so that way you will get your LP valid till 12 months from the date of your Medicals otherwise they will only issue you the Landing paper according to your current passport expiry date.

The problem is that I contacted the indian consulate and they told me that they can only renew my passport 6 months before it expires. I havent reached that window yet.

My interview is in Detroit.

1) When we inform the visa office about passport expiry then which office is that.

2) Is there a number to call them or should I write or fax to them? I tried calling them many times but there is no live person there.

3) Since Landing Papers take 4-5 mtsh after interview could there be a possibility that they may issue a landiang date which is already in the past. (eg I get LP on May 2002 telling that Landing Date is on Mar 2002 due top passport expiry) ?
