Asylum pending: Keep F1 status or not?

Hi everyone,

I have asylum application pending and I still have my F1 status valid.

My university will consider me resident for tuition purpose (because i have asylum pending) and I can pay resident tuition only. If they do that, I will lose my F1 status! Because they will remove me from SEVIS system.

I really need your opinion now!

Should I do that?
Is it worth to lose F1 status and pay less tuition?
Would I get an asylum interview sooner if I go out of F1 status?
Can I go back to F1 in case my asylum gets denied?

Any opinion matters! I appreciate in advance!

--> If you are having hard time paying your tuition then that's the way to go.

Is it worth to lose F1 status and pay less tuition?
--> Its your personal choice. If you loose F1, you case will be transferred to court where you get more chances to get approved and have a EAD with you all the time.
-->If you keep F1, you case will be closed and you need to open new case with new evidence. However, you can get H1b and eventually Green Card but that's a long shot.
Also, once your F1 expires, if you leave country and try to come back in F1 or any other type of visa, chances are slim to none that you will get the visa.

Would I get an asylum interview sooner if I go out of F1 status?
-->For some people, if they are out of status then its sooner but in most cases, its random. Its your luck and that scheduling office's computer.

Can I go back to F1 in case my asylum gets denied?
--> If you case gets denied, you will referred to court. You can try applying for F1 again but again chances are slim to none to get F1.
Once you are denied, you need to fight all the way.
