Asylum marries an overstay

I came to USA with B2 visa in 2004 and I overstayed since then

Now I met my boyfriend and we fell in love and we want to get married.

The problem is he doesn't obtain the green card yet. He's waiting for it since 2002. He told me he'll get it soon.

1. What would happen if we get married before he gets the green card?

2. Should I wait til he gets green card then get married?

3. Will my overstay visa affect me? Will I get deported if they find out?

4. If I married him before he gets his green card and I file the form for GC, will I be able to get an ID, driver license, #SSN while waiting for it?

5. If I married him after he gets his green card and I file the form for GC, will I be able to get an ID, driver license, #SSN while waiting for it?

6. How long will it take me to get GC? We live in San Francisco.

Thank you so much!!!!!

Emiko, I dont want to scare you, but as an overstay, you are in serious trouble. Before his GC, the only benefit you can get from your boy friend is through an Asylee Relative petition, which may take a while and your overstay will make that questionable.

One possible solution is the file the relative petition and go back to your home country and wait for it there.

Good luck

Emiko,
You will not be able to be the beneficiary of an Asylee Relative petition because your marriage would be taking place AFTER your future husband would have obtained asylum. So there is no way you can benefit from his status until he pretty much becomes a US Citizen.

1- Nothing
2- Up to you
3- No
4- No
5- No
6- If get married before he gets GC,he's not gonna be able to help you.If you get married after he gets GC,he's gonna help you get GC by filling form I-130.But at this stage,it will take you 5-6 years to get your GC.No Work permit,no driver license,no social security card in meantime.
If he gets his US citizenship and apply for your GC,it will take you less than a year to get your GC.Before you get your GC,you will be able to get work Permit,SS,Driver license, advance parole(this allows to travel abroad while waiting for your GC) as benefit for being spouse of US citizen. To get GC from your boyfriend after getting married, allow yourself 5 to 6 years from the time he gets hifs GC.Still long way to go.
Good luck and don't hate your boyfriend...

Emico, first of all, we all giving you advice assuming that your boyfriend have applied for GC due to granted Asylum status. Is that correct? Just making sure, because in the information you've provided doesn't say anything how he got his GC.
