Hi,
My wife was in our country recently. She was assulted by a rebel extremist group. Her family is a frequent victim of extortion since they are associated to one of the mainstream political parties and also own a factory. The rebel group periodically collects money and threatens if demands not met. There was a case last year, during a meeting, the president of the industrail area, was publiclly dragged out of the meeting and physically manhandled by this group.

It is very unfortunate situation and we would like to apply for asylum. She is in H4 and I am in H1B. She will be returning on Feb 10, 2010. Will applying for asylum affect my H1B status? My current employer is not 100% sure to sponsor for my GC. We were in process for GC application until the final stages of filing for PERM. He says there was one US applicant whom cannot be rejected because there is no possible reason to reject him for the job advertised.
If we apply for asylum will it affect if I applied for GC?

Very simple. Dont apply for asylum unless there are good and complelling reasons to do so. If they determine you filed a frivolous asylum application your future in this country can be ruined. If you have remaining family there they will question how they are there living unharmed and owning a factory. Asylum is a status granted to people who face persecution on account of race, sex, political opinion etc....From what I can tell the story you mentioned does not amount to persecution by any means.
