I have hearing on my asylum case before the judge early next week but now the DHS attorney contacted my lawyer and says he hasn't got the referrel assetment from the gov and therefore will file a motion to have my hearing postponed to a later date mabe 6 months or I don't know.

The court and DHS attorney has all the files they need. The refferel assstment is the note by the asylum officer at the asylum interveiw during which I got referred to a judge! My case was filed way back in 2004 and had interveiw with asylum officer way back in 2004 and it's not my fault if DHS attorney has this or don't have that.

I am very disappointed to hear this news from my lawyer but my lawyer says we will go to the hearing next week as scheduled and see what happens and ask for the judge to make the hearing happen that day.
The DHS sttorney might be granted his request for my case to continue to a later date by the judge but my lawyer says she will not agree for months of postponement but just weeks!

I am very unhappy and I feel that I have no luck to live in USA.
I got postponned again and again and was looking forward for the hearing next week but that also seems to get postponed one again.
I htink I should get the hell outa this country and go somwehereelse maybe to canada cos I don't have any more pateince to wait and wait and wait.
People who came later me gets asylum on time and I am getting stuck just to a hearing for years.
I have been in the State FOR 7 YEARS in limbo.

What's your suggestions, Idea or tips for me?
thank you

Action6,
I so totally understand your frustration. it is so up setting, more patience. Going to Canada won't resolve your asylum case (with the 3rd party agreement, a petition for asylum in Canada would most likely denied, if the applicant previously applied in either country).
-When your lawyer, or the Immigration Judge, or a DHS attorney canceled for some reason, chances are you won't even see any hearing scheduled on your name for the set date. I empathize your grieve, your pain, your sorrow, but unfortunately that's how the USA Asylum System is "most cases are in limbo" and shame on USA. I belong to a small immigrant organization that assists immigrant for their asylum application, I swear there cases that have been pending over 10 years, from asylum office, immigration judge, board of immigration appeal, Circuit court even Supreme court ETC...
USA is not a heaven for those who fleed persecution from their homeland.
hopefully, your case will soon be approved, so that you could get out of that mess. Hang in there, don't get discourages, and again I empathize your grievances

Best wishes & Best Luck.

I fell the need to let you know that I completely empathise with your situation. There is nothing like being in limbo about your immigration status. I remember when I used to wait for my asylum interview i would have nightmares... And even now as an Aslyee I still have a lot of moments where i panic, just because you are constantly on the ropes....

I have lived in the US for 14 years and applied for aslyum about 2 and half years ago... long story. Right now I am so desperate to get my greencard just because For the last 14 years I have been very unsettled in my personal life. It is impossible to settle down and get involved when you are not sure what tomorrow offers, in terms of permanancy.

You have waited a long time, and only you know what your life has been like. If you still have it in you, hang in there... get through the interviews, give yourself this year as a decision making year. It is tough to keep putting your life on hold. I hope that things work out for you, and you make the best decision for yourself!
