Asylum being investigated

I applied for canadian skilled worker program(done physicals 2 weeks ago). Well, asylum in US granted 2002. Applied for GC in 2003. Had 2 fingerprints and 2 physicals done. Sept 2006, my file was transferred to the Chicago Asylum Office. Called them many times to find out the status. Did not hear anything from them. Consulted a lawyer and found out my case is being investigated. (lawyer says could be anything) The asylum office cannot give any more specific info since is under investigation.
My question is this....can I request voluntary departure at any point of my immigration process?
My lawyer says we should fight any decision but I am so sick and tired of dealing with USCIS.My Lawyer says don't leave for canada because USCIS will penalize you for leaving US and will ban me from entering US for 10 years or more.

Interesting question. Are you asking if you can "officially abandon" your application?
 
Another question I would have is:
Have you lied, made fraud or something similar in your asylum case?

If not, then there is nothing to worry and just wait till CIS finishes its investigation or your application for skill worker gets approve in Canada.

Leaving the U.S. at this point would tell CIS that you are leaving because you are either hidding something or whatever CIS is investigating is true and you are just running away.

I am not worried what INS thinks at this point, just the feeling of dealing with them any longer makes me sick. I am disgusted by the whole immigration process in the US. My family and I need to move on, cant wait for the I-485 to get approved or denied any more. If I get voluntary departure, maybe I could come back sometime and work in the US after becoming a canadian citizen. I work in health care and my profession is in high demand in US and Canada. Thanks for your replies.
 
Then... you have the answer.

You are FREE...you can leave the U.S. anytime...
Just remember that you maybe ban from entry in the U.S. for 10 years...

I heard if you request voluntary departure USCIS will NOT ban you from entering US again but if you left without telling them, they could ban you for up to 10 years from entering US. Just wondering if anyone know this answer. Otherwise I will post here again when I ask m y lawyer about it. Thanks guys for replying. Appreciate your input.

i have same like you after fingerprints my case was transfered to sanfrancisco asylum office .i tried to contact them couple of time but all in vain.i tried by congressman now i recieve a letter stating that they are investigating my case i do'nt know how long it's gona take.if you find any update please email me @sukhipatiala@yahoo.com
 
Since OP was granted asylum in 2002, I am wondering if the investigation is to make sure his asylum complies with Real ID act of 2005.
