Hi, Had a couple of questions I need help with. My wife has a greencard through asylum status (China). I believe once a person gets a greencard, they can apply for citizenship after 5 years. She's had her greencard for 4.25 years right now. Her father has cancer and she really wants to go back to China to visit him as his condition seems to be getting worse, but I've been reading that it's not advisable as the US might revoke her greencard on her return since she's on asylum status. My questions:

1. I heard somewhere that one can apply a few months before the 5 year mark as it takes several months to process, is this true and does anyone know how many months before the 5 year mark that one can apply?

2. Can she travel ANYWHERE outside the U.S. with no problem, EXCEPT for China of course, or does she need any particular travel documents first?

3. What is the time frame to get citizenship once a person applies?

4. IF her father passed away or something in the very near future, and she HAD to go back and didn't get any paperwork or anything and just went, what kind of complications could she run into upon her return? Does being married and having her life here with our home etc have any bearing on anything? Could they deny her admittance in the U.S. and not allow her to come back, even though her husband and rest of her life is here in the U.S.?

Thanks for any help anyone can provide!

Hi,

Are you a citizen?

If a Permanent Resident is married to a U.S. Citizen, they only have to wait 3 years before applying for U.S. Citizenship.

So....

If you are a citizen your wife can apply for U.S. citizenship now and see if she can get it expedited.
