I am presently in the midst of moving my H-1B visas to another position, and I would be very grateful for any advise or insights from anyone who have experienced something similar.
To give you some background on my predicament, here it is:
- For the past three years, I have been employed by my current employer under an H-1B visa.
- I recently received an offer that excites me from another organisation.
- My H-1B transfer has been initiated by my new company, and I am currently in the first phases of paperwork.
I'm hoping that you can assist me with these precise questions:
Processing Time: Taking into account both standard and premium processing options, how much time does the H-1B migration procedure normally take?
With the current processing timeframes, any recent encounters would be especially beneficial.
Work Start Date: Should I start working with the new company as soon as I received the reception letter from USCIS, or should I wait until that transfer is fully approved?
Travel limits: Should I be aware of any travel limits throughout the H-1B transfer process? In the next months, I have a trip planned, and I want to make sure that it doesn't conflict with my transfer.
Effect on H-1B Cap: Will my present H-1B cap status be impacted in any manner if I transfer my H-1B visa? Three years ago, I won the lottery, so I'm not sure if the transfer will make a difference.
Documentation: Which particular documents need to be in order for the transfer procedure to go smoothly and without any hiccups? Any advice or checklists would be very beneficial.
