folks:
485, ND 08/10/01
3rd AP (ND 5/15/03)
It is over 200 days since we applied for renewal. We now have a family medical emergency. Fortunately my f-i-l is out of danger - critical but stable condition. I badly need AP to visit my father-in-law.
We contacted the TSC thru John Edward's (NC senator) office for emergency parole and the reply was absolutely ruthless.
Quoting TSC...
"The Service has to review all conditions relating to such expedites....any type of surgery could be considered dangerous; however the service has to look at the overall seriouness of this request and could not view it as a life threatening situation.
The documentation provided on this second request does not show the urgency of a life or death situation. It states that the father has been suffering from kidney disease for the past 4 years and been hospitalized before for this condition. Finally according to the report, he is stable condition.
Therefore the request was denied."
To me this is absolutely ridiculous. How can they tell me if my father-in-law's illness is worth a trip or not?! Do they want him in death bed?? so there is nothing in-between death-bed and critically ill ?? How arrogant!!
Charlotte USCIS has taken a policy of NOT issuing any AP (interim/emergency) IF there exists a pending application at TSC. This was communicated by the director of Charlotte USCIS to my attorney. When asked why he is deviating from their previous communication to AILA, the director said he simply "doesn't care". He won't issue any AP. So, I am at a disadvantage for
living in NC!!
How come they issue walk-in AP for folks in other states/regional offices?? Where is the consistency?
Gurus - any help, advise is appreciated.
I have just 2 weeks between now and christmas and worst of all I have bought tickets for dec 30th.
On Oct 15th, TSC was processing AP ND April 21, 2003. Today the processing date is April 29th!!
thx
