I was arrested back in 2001 for domestic violence and pleaded guilty and was fined $200.00 no jail term. When i filed my I-485 i told all this to my lawyer i assumed he had indicated so in the form, but a week ago i got a letter form USCIS requesting court and police record for this arrest. I went to check my copy of I-185 was dismayed to find out that he did not check YES for the arrest. Now he has prepared an affidavit explaing the case and notorised to send together with the court records. Is this a common practise and also what is likely to happen regarding this issue. Your reply is highly appreciated.

Trying to hide arrest is more serious than arrest itself. A similar case was recently posted here.
USCIS has approved cases like this (posted on this forum). However, they can deport also.
If your attorney is not competent, you may want to hire a good attorney.

Good luck...

Hi kepham

You are not alone, I got myself arrested when there were small altercation between me and my wife two years back. I was not in jail. Police took me to Police station and took my FP and dropped at my home. Next day Judge dismissed the case. My I-485 is pending in Dallas office after FP,Name check and IBSP..... I was very distressed after that incident. I know my I-485 will be either approved or denied. I never know I was arrested so I did not tick mark in I-485 form, after obtaining my FOIA report I came to know I was arrested as this is my first experience with Police in real life. About FOIA you can find it out www.uscis.gov. Detail info is provided. I obtained the police report from FOIA. My attorney amended the I-485 form page 3 after I obtained the FOIA report and sent it to Dallas office. I am not sure my attorney has amended the I-485 form or not as I have not seen the amended I-485 form which my attorney has sent without my signature.

Hi shankar123

From the date of receipt it is 25 days for I-485 case. 90 days for I-485 + I-140, please let me know if you need any other info.

Check you FP 1st before answer I-485

I had the same problem with my ex- in 1993.I had one year probation, and the next year the judge told me the case dismissed, just like nothing happened. I even took my arrest FP back. So when I file my I485, I didn't check the record. I also requested a FP check by myself via FBI, the result was clearn. Now I'm waiting for my FP from USCIS. I hope everything is fine.
