arrest issue - h1b stamping

I was arrested in 2002 for domestic violence (simple/assault and battery), and they later didnt pursue the case as my roommate didnt pursue it further. I have a copy of arrest record & letter from public attorney office saying that they didnt pursue the case as victim chose so.

Speaking of truth, I did slap my roommate in face 5-6 times over a
personal issue.

This happened while i am on f1 and now i moved onto H1. I am planning
to attend h1b visa interview in canada next month. I am worried about my h1b stamping. I appreciate any help in this.

What i should answer my interviewer: That i slapped my roommate multiple times. Would they consider it pleaded guilty?

Regards,
sd.

If you are not convicted, then don't worry.

I would advise you to get your FBI finger print search results and see what shows up there. If you are convicted of a Domestic Violence case , then you will have problems get a H1-B Visa stamped and also entering into U.S at the airport ( normally known as Port of Entry ). If you were arrested and not convicted , then it is not a problem. However, please carry all your arrest records, Court disposition records etc . with you to show to the consulate officer. Generally, any crime of moral turpitude will cause problems getting a Visa and entering into U.S. I also suspect, if you would even get a Temporary Resident Visa to visit Canada to get a U.S visa at a U.S consulate in Canada.

How will a finger print with FBI show up the fact that he was arrested for slapping? Unless the police took his fingerprints when they arrested him I do not see the correlation. Could you explain?

thanks skgangi, i have arrest record & prosecution denial record(case never made it court) with me.

When contacted, court said they cant issue any disposition records or such, as case never made it court.

Will prosecution denial record from county prosecution attorney do in such a scenario?

Tennis court, you are right. If they took the finger prints at the Jail after he was arrested, they will show up in the FBI search results.

FYI. Stated i am arrested & provided necessary documentation. Got visa. be honest is my advice for ppl who may get into this situation ever.
