Are they really only processing Aug 01 cases currently?

I don't know what to believe now. We've seen so many people got approved for Nov 01 and even early 02 cases, however they still claim that they are only processing cases upto august. My RFE was received by NSC on April 8th and my fingerprint is gonna expire in mid-june. My lawyer helped to call NSC today, same old same old. The only thing kind of interesting is she said that aug time thing is not just from INS, is also confirmed by AILA. I was kind of worrying getting second FP and fell into another who knows how long wait, well, life is life, what the heck. I guess I will wait and see what kind of games they are going to continue:) .

If you talked to IIO, she would say NSC is processing August cases but in reality, it's not the case. It depends on two things

1. First most is the officer who's reviewing your case.

2. How fast they your clearance.

I suggest don't completly count on processing dates. Just hope that officer has reviewed your case and he is just waiting for the clearance.

they have already adjudicated 50-60% of all I-485 applications from January / February 2002 RDs. Will be interesting to find out what s/he says.

Can you please tell me where you fot the 50 to 60 % of early 2002.

Rupnet.com does not suggest that. They just touched a handfull of cases in with Dec 01 RD.

I told her similar thing but I can't convince her that the statistic data we got is reliable. She just said this was confirmed by AILA (Association of immigration lawyers?). Another result from her call is my case has been returned to a IIO after they received my responce. According to so many threads with IIOs, I don't know if I could trust that either.

The processing dates that are put out by the INS through AILA (note that this information is not in theory available to the public even though INS is a government agency) are just intended to serve as a line in the sand to trigger status inquiries from applicants' lawyers (and it seems, also members of congress). In order to limit the number of such inquiries, the service centers tend to move the published processing dates only after they have been able to clear out almost all of the backlog as of such dates. So for example, NSC will move forward from Aug. 22, 2001 for I-485 (EB) cases only after they have finished processing, say, 95-99% (this is my guess, the actual level may be different) of the cases filed before this date.

Hence, the dates are unlikely to provide an accurate picture of the actual processing situation at the various service centers.
