Hi All
Thanks in advance! I am in a dilemma. My company's lawyer tells me that according to a new rule, only a few selected positions are available for GC processing. Currently I am being employed as Software Developer 2 and according to the lawyer this position doesnt qualify for GC processing by INS. Is this correct???

Depending on which field you work in and your job description, you can file under either 999.151.021, 999.151.031 or 999.151.032. Your job title in your company usually does not play any role in determining the INS classification - it is only the job description. You should qualify for these positions though, usually they require a BS (US Std)/BE (Indian Std) or its equivalents.

Thanks a lot for the advice. But what are "999.151.021, 999.151.031 or 999.151.032" ??? I am new to this scene.. and am absolutely clueless!

These are the codes which INS/DOL assigns to your job category. You can look up the code here http://www.bls.gov/oes/2001/oes_stru.htm . Just drop the 999 part and re arrange 151-032 as 15-1032 and check the page for this code.

Eg 15-1032 says "Computer Software Engineers, Systems Software", click on the 15-1032 link and get more information, including wage statistics etc.

These codes get assigned based on the type of work you do, for example working on Java projects might get you in as 151.031, whereas working to implement Java itself (say Java compiler - rather than writing apps using Java) might get you into 151-032 code. I think the codes are assigned by the SESA, but I could be wrong and maybe the attorney's have a say in this matter.
