Did anybody get RFE in EB1-OR category? Is it common to get RFE ?
What are the chances of approval or rejection after RFE ?
Any opinion will be appreciated.
Thanks
It depends. If only some specific questions, easy to answer, most likely, you are OK after you answer questions. However, if they post lots of doubts, question if you fit the catagory, most likely you are NOT OK, even you try to respond.
I will post the details of my RFE. I just heard on AVM that
RFE was sent a week ago. I have not seen the details of RFE yet.
Another question, If I get rejected, can I still apply in a different category such as EB2 or EB3 ? If I can, does a rejection in EB1 category has any affects on the application in EB2 or EB3 category?
Please help
Thank you,
Lionking,
Thank you for your answer.
I am waiting to receive the RFE. I do not know what the result will be
after I reply to RFE. In case of a negative result, I just wanted to know my other options. Of course I am hoping for the best. When I receive the RFE, I will have a better idea about what they request.
Please post your qualifications here so that people can
give you proper advise on how to handle RFE (yes, even
before you actually receive it). More specifically:
1) What are your educational qualifications ?
2) What are your research/scholarly contributions (papers etc; how many; where) ?
3) Do you believe you meet 2 or more of the EB-OR criteria ?
4) Did you submit enough documents/proofs to justify your belief ?
5) How many letters of reference did you submit ? Of those, how many were
from outside your university/company ?
If you write these details here, people would be able to help you more.
I have an MS Degree in Electrical Engineering from a US university.
I am in the final stages of my PhD studies and hoping to get my
PhD degree soon.
My research is on the prediction of the heart attacks, sudden death
before it happens, development of new techniques. I work with people from both medical and engineering field.
I have 5 journal papers all published in medical journals but I am
not the first author in any of of them. (Mostly second author)
I have more than 25 abstracts and conference papers. (More abstracts than conference papers) Again I am the first author in
3 of them and mostly I am the second author.
I have one US patent. (actually by the time I applied for EB1-OR I had one patent but I got another approved recently so I have two now) Second author in patents.
6 citations. (Journal papers are recent)
I also had 6 reference letters. 3 from my university and 3 from other.
All from US except one.
These are my qualifications. I applied in EB1-OR category and got RFE.
What do you guys think?
Thank you
1. Letters of recommendations are either:
a) not strong enough to explicitly say how important your research is,
b) not varied enough (not from diverse sources)
2. The min. 3 yr research experience letters might have been week in
saying that the research you performed was outstanding.
In any case, you will need to provide *updated* and *stronger* letters
of reference from *diverse* sources.
Thank you. If this is the case, then I guess I need to ask different
people to provide me new reference letters. But can I still ask the people who I got reference letters before to write me stronger reference letters ?
Congratulations for succeeding at NIW. Can you provide details like, INS Service center (VSC,..), RD/ND, AD, RFE date, details of RFE, and if you don\'t mind, your background.
Except your student career, do you have 3 years of experiences? If they question about your 3 years of experience cited from your student resesarch, hard to persuade them.
I guess they may question your other qualifications.
HI:
Goodluck, may you be successful with your RFE!
I would appreciate it if you can help me out! Could you send me a few of your reco letters and cover letters.
