Subject: HOLD ON I-485 PROCESSINGSFYI...
The INS has placed a hold on processing I-485s in which a acquisition/merger
has occurred prior to final determination of the green card application.
This decision will effect all former CPI, IMI, and SQP consultants. As a
result of the new regulations passed in October, adjudicators are awaiting
direction on how to handle those cases that are currently in the pipeline.
It is anticipated that a ruling will be announced within ninety (90) days.
In the past, the INS has requested acquisition documentation at the end of
the I-485 process, which has resulted in immediate approval. As the
petitioning sponsor, Ajilon can submit another I-140 petition with evidence
of the acquisition, however, the INS would treat that petition as a new
filing. The I-140 would be placed in the new petition queue which currently
has a processing time of 9-10 months.
The Immigration Processing Unit is receiving a great deal of pressure from
consultants to refile the 140 petition so that the green card process can be
finalized. We feel, it is not in the consultants\' best interest to proceed
with the refiling at this time. Instead, it is our intent to wait for INS\'
ruling. If the consultant insists that another I-140 be submitted, IPU will
submit a petition on his/her behalf, however, the consultant will be
responsible for the fees. As always, that fee can be waived if approved by
a District Manager.
