APs pending for over 6 months

Guys and Gals,

Me and my wife applied for our 2nd APs and 2nd EADs in Jan 2005. After transferring both our EADs to the Miami office, TSC somehow recalled them and approved them in Feb 2005. Since then my 140 has been approved and an RFE has been issued against my wifes 485 app. The problem is that there is no word on our APs that were filed in Jan 2005. The official processing dates for APs is well beyond our date. I have called and placed inquiries and have also received stupid letters stating that the "supervisor on the floor" has been notified. I have tried to get my lawyer to do something. No one can give me a straight answer.

There was a LUD change on my wifes AP on the 3rd of June but the app is still pending. I do not need my AP but my wife does. Any suggestions as to what I can do about this damn problem.

I was hoping that they were not not approving our APs because they would just approve our 485s. With each passing day and with all the retrogression, I am not so sure any more. If these guys are not going to approve our 485s then the least they can do is approve our APs and EADs in time. Is that to much to ask?

I feel your anger and pain. I also thought you were being approved soon since the Ap situation. But now with all this mess on freezing up approvals I'm not sure. I think the only one who can help you is your lawyer by sending an inquiry or something like that. Hope you have a nice lawyer, because mine does'nt do anything for us... I really don't get it because usually EADs and AP are approved at the same time or maybe few days apart and lately very rapidly. SO I suspect there must be something going on, don't know if is good or bad though... Have you asked your lawyer if you can apply again??? (if it's really urgent for your wife)

Thanks for your kind reply. I will try calling them again and see. I am really not sure what is going on. My case is straight forward. Infact my co-worker from the same country as me, with the same degree, experience, and even the same department within the company as me got his approval in Jan 05. Both our cases were filed the same day, our lawyers are the same and all our paperwork is the same. I have never been in any trouble or out of status and neither has my wife. Not sure why my case has been cursed. Nothing has been starightforward. I can understand name check problems but to transfer the case to an office in Miami when I am in GA and then to transfer the EAD to Miami and not approve AP. Its just that my case has fallen through the cracks and they are just not willing to correct the situation.

Lets see what new surprises are in order for me.

how do people know they are getting name checks from FBI
 
Do you get higher pay than your co-worker?

Seriously I am sorry to hear about this. But I think it is a good excuse to let TSC
know that and you might got your 485 approvals. Try hard!

It's just plain luck as I come to realize, I have a very close friend who had the same case as mine, same lawyer, same grounds, everything... The only difference is that she applied 3 months AFTER than me, and she got approved 12/04 no RFE no 2FPs....
It's a lottery, there's no other logical explanation.
