Approximate length of time from I-140 to I-485 approval?

I recently got a new I-140 petition approved in the EB-2 (India) category and I got the PD substituted from a previously approved I-140 in the EB-3 (India) category. My PD is in Oct, 2002 and so my dates are current. Both the I-140 approval notice and the new I-485 receipt list the recaptured PD correctly and so I'm happy. I'm wondering how long before my new I-485 gets approved since the dates are current? My lawyer found out today that a request to do new biometrics for my case was sent out and I should receive that soon.
 
If one's priority date is current, a fingerprinting notice for a long-pending I-485 case is a good sign (though not a guarantee) that approval is near. Expect the approval within 1 or 2 months after your fingerprinting.

Just to clarify, it looks like the fingerprinting notice is for the new EB-2 based I-485 and not the older one based on the EB-3 case. I have yet to receive the notice though and I'm keeping my fingers crossed that the EB-2 visa dates for India do not become unavailable during the next 2 or 3 months. :)
 
Are you saying this is the first FP notice for the EB2 I-485? If that's the case, you probably have at least 3-6 more months of waiting, and you'll have to hope that retrogression or unavailability doesn't kick in while you wait.
 
That is correct Jack. By some chance, my I-40 got approved in 9 days (regular not premium) and so it's only been like 3 weeks or so since my new EB-2 I-485/I-140 were filed together. So it is my first FP notice for I-485. How many FP notice's will I have to go through before the actual approval? As you said, there may be a chance of unavailability of EB-2 visa numbers but I'm guessing that the EB-2 India dates don't get retrogressed all the way to 2002. Another 3 to 6 months??? :( I've been waiting since 2002 so I guess I can wait for another couple of months. :)
 
So I got my fingerprinting done recently for this new EB-2 case. Interestingly, it was a "Code 2" type fingerprinting which supposedly means that I didn't need to get all my fingers scanned. Only the index finger was scanned a picture was taken. The guy at the fingerprinting center misread the code for my wife and scanned all fingers again (basically did a Code 1) but the supervisor there said that it was not a big deal.

Anyways, what do I do now? I just called up the USCIS to see if they could give me any specific info on my case but I got the usual generic info on processing times and such. Jack, do you still think another couple of months of waiting? :)
 
Background checks, and handling other applications that were pending before yours. Including digging up those that have been pending for years and their priority date just became current. They're going to get priority over recently filed I-485's.

Yes, amongst the set of applications with a current PD, the usual practice now is to give preference to the ones with older I-485 receipt dates. Although in the past they seemed to treat the cases in random order.

A follow up question would then be...Should I have instead opted for I-485 substitution instead of the new I-485 after doing the PD recapture?
Interfiling would have saved some money, but it wouldn't necessarily save time, due to how they are often slow and sloppy with handling interfiling requests (continuing to treat it like the original EB3 with non-current PD instead of treating it as EB2 with current PD).

So, FP or medicals not yet done.
How much more wait do I have?

Also, what is the likelihood of further retrogression in EB2IN?

Hello again Jackolantern. I've heard about many EB-2 India cases being adjucated recently. I'm getting so jealous. :) Anyways, I noticed that there are like a total of 100 or so cases left before the Oct,2002 for EB-2 India. But I guess I'll have to wait behind even the 2006 PD's that are getting approved since they have an older receipt dates?

Any new guesstimates for me Jack or am I getting too impatient? :)

My receipt date for the I-485 is 03/08/2011. So it's been 3 months now. You think I'll get it now? :-D

Just kidding Jack. Thanks again for replying. I've been waiting since October of 2002 so what's another few months. Right? :-) I'm the only one among my friends without a green card now and so I've been feeling lonely. :(
 
Hey Jack, I finally got my green cards (including spouse) in the mail today. It's been a long 9 year journey for me but I'm glad that it's over. Thank you very much for your support over these years. It is such a relief!! :)
