Approved!

The RFE was about:
1. Birth certificate from a civil authority (the birth certificate I submitted from the hospital was not accepted)
2. Current employment verification
3. AC-21 portability letter (I had changed employers)
4. Explanation of an approved H1b petition for an employer who I didn't work for (I was offered a job which then fell through in the last minute)
5. Arrest records and court dispositions for a disclosed conviction
6. Proof of work authorization for my first employer (where I worked using my OPT)
7. Signed G-28 (my attorney apparently forgot to sign the one that was sent in)

Regarding you point #4, Do we need to produce a H1 even if we did not work for that company? 5 years ago, One company did my H1, but, it did not work out well, so, I dropped. Do you think, they will ask about it? Please let me know. Thank you in advance.

My situation was this: Company B offered me a position while I was employed with Company A. Company B filed for my H-1b transfer, which was then approved.

I ended up staying with Company A as Company B had to retract their offer due to the downturn of the economy. So, I never worked on the "new" H-1b, and remained on the existing one.

In my I-485 application, I did not disclose this event as I had not worked for Company B at all. They did perform a search of my records and asked me about the H-1b approval they had on file for Company B. So, in my RFE, I explained them the situation (as I did above).

I don't know what your situation is, but that was my experience. Hope this helps.

I am also on the exact same boat. Also, I don't have that H1B approval notice with me! So, Do you think, an explanation would be enough for them? Please let me know.

My RFE said "...Service records have another approval for (Company B). You do not show any employment with this company. Please explain".

I did send in my approval notice although it didn't specifically ask for it. I also sent them an explanation of the events, as requested. So, you might be able to get by without the approval notice. My recommendation is to cover your bases and try to get the notice from the attorney or from whomever might have a copy of it as you can never submit too much documentation, right?

I was very ımpressed on how quıckly they turned around my RFE (9 days, and that's including 2 weekends). The response was very well documented (thanks to the attorney who prepared it), and that probably helped in this case.
