Approved LC, Can file I140,485 jointly before Dec15th?

My new company has a pre-approved labor which fits my profile/salary/title everything. I have BSc with 8 years of experience.

a) I guess I come in EB2 Cat. Am I right?
b) Can my company file I140+485 combinely before December 15th? (Without getting negetively effected by this new retorgasion law)

Please share you advice.
 
Thanks for your Quick Reply. But do you think I fall under EB2 or EB3?
And i guess the new rule only applies to EB3 isnt it?

FYI. I would like to post a small FAQ on this new process, hope it will help new comers to understand what they should concentrate on to get GC in timely fashon.
 
EB2 & EB3 category is not decided based on what qualification + experience you have, it is decided based what is defined in labor (form 750A). If the requirement says BS + 5 years then it will come under EB2 , if the requirment in labor says BS + 2 years experience then it will come under EB3.

Just to let you all:

We got LC approved with Masters in Business/Science/CS with one year expeience. After LC approval we applied in EB-3 category (on form I-140) but still USCIS approved my case I-485 in EB-2 category.
