I have been on H1 for various companies for over 3 years, and I joined my new company because they were very prompt in filing GC stuff.

I just got my Federal Labor approved.
State Labor NH Filed June 2004 Approved June 2004
Federal Labor Sent July 2004 Approved Sept 2004.

I dont want to take this for granted because I have friends in California and NY waiting for State labor approval for over 2 years.

I am still looking to get engaged, there are no concrete plans yet (still looking for a girl :D ).

The reason the questions are important to me is : I have yet to find a girl to get engaged (or married) yet, and i dont want to hold on for that and lose time for I-140.

I was thinking that I could at least file for my I-140 now and then file for I-485 later after I bring my spouse back to US on H-4. I have read on this site and elsewhere that the consulate in India can deny issuance of H-4 if I-485 has been filed even if it has not been approved.

Can they refuse H-4 visa even if I have filed I-140 or/and it has been approved?

Should i file for I-140 now?

OR

Should i wait until (i dont know when) i get married, get my wife here on H-4 and then file I-140/I-485 concurrently?

If you file I-140 alone can you file I-485 after that before I-140 gets approved ? (Concurrent filed separately)

Is concurrent filing I-140/I-485 faster than stand alone I-140 and then I-485 or I-140 and then I-485 pending I-140? How about the pilot program where if you file concurrent you might be the lucky one to get both I-140/I-485 get cleared in 6 months?

Please advise.

File I140/485

It takes abt 12 to 18 months for approval. Meanwhile get marry. No problem to bring wife to US till 485 approved. You need to get H4 stamping before 485 approval.
