I have a peculiar situation. I used my colleague's approved labor petition (labor subsitution) to file only for my I-140 and not 485 as I'm impacted by retrogression. My colleague didn't end up using his approved labor as he filed for his I-140 and 485 as a derivative of his wife. The I-140 I filed for got approved. Unfortunately though my collegue's wife had her I-140 petition rejected. Given this he now wants to file for his I-140 and 485 using his approved labor petition. I'm fully in support of this as he tried to help me and I will certainly do my bit. However, I wanted to find out the following:
1. My Labor petition is currently at the PBEC. Once approved ( whenever that happens), and I file for I-140 and 485 - will there be any implications given that an I-140 has already been approved in my name?
2. What happens to my approved I-140 if he files using the same labor petition (i.e. his original labor petition )?
Any insight or information you can provide will be of immense help.
