Approved I-140, but Need to change job. Help!!

Hello,

My Priority date is 1 Jan'2003 under EB-3 Category, I have I-140 approved but have not filed for

I-485. But unfortunately, I am forced to leave the current job.

I also have got MS in Computer science.

So can I apply for a new Green Card with another employer by retaining my previous PD(1 Jan'2003) and

file the GC under EB2?

PS: I will finish 6 years in USA on 1 JAN'2007.

Q1) Can I retain my PD when filing new GC under EB2 given that earlier GC was applied in EB3??

Q2) Are there any other risk given that I complete 6 yrs working in US on 1 JAN'2007.

Q3) Can I file for extension of H-1B, if I change job now, the new employer files for my GC butonly 6 months are left for 6 years completion in US.

Please HELP!!!!
 
Hello,

Yes. You can retain your priority date. Keep a copy of approved labor and approved 140, to prove the priority date of Jan 1 2003.

I don't know the answers to question (2) and (3). I would ask a lawyer.
