I just received notification that my I-140 for Executive managerial position has been approved. Also I already received my employment authorization a few months ago... I have filed that together with I-485 in may 2005 to Texas.

Now what does an appproved I-140 mean? And what is going to happen next?

I have submitted birth certificates, my history, medical examination, finger prints etc already. I am a female, 30 years old, no criminal history, with complete education (high school and college) from the US, no shady background (except a lot of travel)... any ideas how long that will take, how my chances look like to get a GC after I-140 has been appproved?

Also, I heard that there will be a GC interview.. any ideas what that is all about, what they do and what they ask?

Any ideas, info will be very appreciated.

Thanks a lot.

PS: I am already in the US.

Next step is to wait for the I-485 approval (Green Card approval). This also means that you have to go through fingerprinting, biometrics, get your fingerprints and name cleared the through the FBI. This can go fast or drag on for years. If you are affected by retrogression, you will have to wait until a visa becomes available, which can be sevaral years depending on your country. If you are not affected by retrogression, it may take a few weeks to a few months for that approval. In terms of interview, it may or may not happen. most of the time, intervoiews are for family-based immigration and not employment based, but some employment based applicants are called for an interview nonetheless. You pretty much have a very frudstrating waiting game ahead of you and jst have to wait for the USCIS and see when they take the next step in terms of sending you notices of actions you need to take such as fingerprinting and biometrics, and then just wait, wait, wait...

Retrogression?

Thanks for the feedback. I already went for the complete biometric checks a few weeks after I filed I-140 and 485. That was in May of this year.

I am somewhat new with this immigration and dont really understand all of if, but would appreciate feedback regarding retrogression.

I already received an alien number with my I-140 pending case.. but is that the same as a visa number? And how do I find out if a visa number is available and when? Where do I find out if I already apssed the name check?

Also what is retrogression and how does that play a role.

I am from the Slovak Republic - is that part of retrogression?

Thanks for any feedback and clarification on this.

C.

PS: Does an approved I-140 mean that my chances of getting a GC are high? No crimilar recordes etc..

Your alien registration number has nothing to do with available vis numbers. Your priority date (PD) and EB caegory decide if a visa is available or if you are affected by retrogression. Your PD is the date when your labor certification was filed (not approved but filed) with the Department of Labor. That date determines everything from here on, in addition to your country of chargeability (usually country of birth), and EB category (if bachelor, master, or doctorate degree was the minimum required education for the position approved by the labor certification, in addition to the experienced needed). So what country are you charged to? What is your PD? What is your EB category? The answers to these three questions will determine how long it will take for your I-485 to be approved.

Oh, Slovakia may or may not be affected by retrogression. That depends on the EB category. EB-1 and EB-2 from Slovakia are not affected by retrogression but EB-3 is affected several years. Again, what is your PD and EB category?

She is EB2 or EB1 (see "I-140 for Executive managerial position ")

Then her PD is current and will be processed fairly soon as retrogression does not affect her. Depending on the service center, I'm guessing her case will be processed within 2-4 months.

That does not mean much. Could be EB3. Experience or degree is the key, not the position. Could be manager of local Burger King. Unless the company transfers the manager from oversees, which is EB1. Just found this on USCIS:

Some executives and managers of foreign companies who are transferred to the U.S. may qualify for EB1. A multinational manager or executive is eligible for priority worker status if he or she has been employed outside the U.S. in the three years preceding the petition for at least one year by a firm or corporation and seeks to enter the U.S to continue service to that firm or organization. The employment must have been outside the United States in a managerial or executive capacity and with the same employer, an affiliate, or a subsidiary of the employer.

We don't actually know what minimum requirements this position had as approved in the LC. That's why we really cannot established the EB category and provide an ultimate answer to the question. It could be EB-3 as well, meaning it will take several years to be approved. Carolyn424, what was the minimum requirements for this position as approved by the labor condition?
