I finally got approved after responding to RFE: invoked AC21 and a big relief. Haven't been a regular here just checking in this forum once a while.

Anyway looks like the Namecheck memo got the process out of hibernation.

Thanks p235, yes I was stuck in Background checks. Numerous SRs from USCIS provided me with the same answer. Never did any Infopass.

Hope you get approved soon too

Very glad to hear your approval! I am on the same boat. I am going to change job, but not sure whether to invoke AC-21 or not. Could you please let me know when did you invoke the AC-21? After job change? After RFE? or before job change? What triggered your RFE?

Thanks Bill! Regarding AC21, if everything looks clean sure go ahead and send in your AC21. AC 21 has major gray areas as in the SOC code and DOL codes are really outdated but USCIS relies on them (atleast on paper).

I invoked my AC21 after RFE which was well after job change. I am not sure what triggered my RFE (probably address change: I moved within the same area, as in last 2 digit zip code change) but it could easily have been due to the much talked aout namecheck. They dusted my files and got started on the processing. Job description was a good match but somehow the codes changed because of univ to industry.

I am sure they're looking at your files, did you get any recent LUDs on your 485 or 140?

Thank you very much for your information! It is very helpful. I am going to work for a new company soon, and my lawyer advise me not invoking AC-21 now as it is flexible in terms of timing. He also said that as long as the previous employmer does not withdraw I-140, I do not need to invoke AC-21 at all. Based on your information, I decide to take his advice. I will have to move too, about 50 miles apart. Hopefully, that will not trigger any RFE.

A question for your AC-21. How do you prove to USCIS that your job descriptions are same or similar? Do you have to get a job description from your previous employer?

Your approval gave me some hope. My I-140 was approved 02/2006, but I could not file I-485 until 07/2006 because of the visa avialbility issue. My wife and daughter's cases got approved in 01/2008 as my wife has her own approved I-140 although I am the principal applicant for the family's i-485. I think USCIS switched principal applicant for our family. There is no updates for my I-485 recently.

We are also in the same boat as yourself although we only applied in July07. We were here on L1/2 status for 4yrs so we are kicking ourselves about not applying sooner!

I did hope to get the Green Card approval by now as our friends who applied in May07 (2months before us) actually received their cards in Aug07 & they told us that EB1 was the quickest way to Green Card?

My husband the primary is going to have to change jobs although it is the same job but different employer in 2 months time so it looks like we will have to use AC21, Hoping though that god might smile on us before that & we receive our Green Card?

Yes, my lawyer also advised me to not to invoke AC21 during job change. Regarding the job description from the previous employer (as in the one who petitioned your I140), this should have been in your cover letter and the specific code will also be in a field in the I140. You can also be a little flexible regarding your job description as in take snippets from your support letters also.

Regarding your primary switch, maybe they decided to treat you as secondary. What I am trying to say is that if your wife is considered primary, then you as secondary can switch jobs without having to worry about AC21. I am not sure how you can make sure about this but your lawyer could possibly help you get the info.

Unfortunately EB1 only helps you in the I-140 stage and I485 stage only in-terms of visa availability. Otherwise I485 is in the same queue as EB2-3. But at-least the good thing is visa availability.

My philosophy in changing jobs is to just move on with life. I didn't want to decide my career entirely based on immigration status. I think we all at some point have done that but there's a threshold after which it simply fails to be of any benefit. Anyway, I hope that you all receive your GCs soon.
