April 2002 case:
Mine was approved about a month ago (2nd FP end of May 2004 for both No RFE). on the same day they issued an RFE for her case. She worked on H1 long time ago and then went out of the country, got H4 stamp and came back. They wanted to know if she left soon enough (within 10 days of ending work on H1). This was not a big problem because we were covered under 245(k) or 245(i) both in the event of "out of status" (because my labor was filed in 1998 and I-140 in 1999.. both before cut off dates for section 245). They gave us an option to invoke these sections if she was out of status.. we did not invoke these waivers. Since, INS does not put stamp on passport at the time of departure we sent a copy of arrival stamp at destination city.
(My lawyer took 10 days to prepare response )The RFE response was sent on 30th June, online status changed to "RFE received on July 7". LUD changed on July 8. Approved July 12 (online status). Checked online status at around 8:30 pm... nothing, checked again at 9:45pm -> approved... no email this time.
I am done with USCIS for now. They are working faster now but the fact remains, lots of Jan/Feb/March... cases are still pending. It took me over 6 years and I know exactly how it feels. Good luck everybody.
