Was quite surprised today to check online status and see that I-140 has been approved. I received an RFE (company ability to pay) in April, responded a few days after. Now both EAD and I-140 has been approved. Good luck to everyone.

Just got to know that my I140 got approved!

Did not apply for concurrent 485....

RFE issued March 27th. My lawyer received it like 10 or so days after. Responded to it on Apr. 15th. INS received it on Apr. 21st.

Just checked online my I-140 (EB2) got approved.

FP/EAD Dec 2002

These guys have started to move and seems acting pretty fast now.

Iam in same situation, I got RFE for company's ability to pay on April 23rd, company didn't respond yet. I just want to know want kind of documents did your company send to BCIS? like tax returns or any kind of finantical documents?

Since my company has more than 100 employees, all we responded with was a simple letter from the VP stating that the company has x amount in gross profit and x amount in net profit and has the ability to pay the wage approved on labor ceritification. Initially we had submitted some financial statements but BCIS said they didn't have any evidentiary value since they appeared to be generated in the office. So they give us a list of things they would consider as evidence of ability to pay. So we just went with the simplest option.

Thans for your response, I still had doubt, you said initially you send some evidence means after you get RFE you send twice the requested evidences or while filing I-140?

And also even my compnay had more than 100 employess but the thing is I work for that company since 1998. but meanwhile one year I work for different company. so BCIS needs some kind of evidence for me the company can pay. Do you think, the letter your compnay sends BCIS is kind of thing is enough, because my company hesitates to send tax returns. If you have any idea let me know.

Initially when my I-140 was filed we submitted financial statements. That was in Dec. In April when we got the RFE notice it said that the company failed to show its ability to pay the proffered wage since the financial statements seemed to be generated from within the company (I don't think they were certified by an accountant, they were just signed by one of the owners) and that they hold little evidentiary value. In response to the RFE we just submitted the letter which was one of the options on the RFE. If your company employs over 100 employees then a letter should be sufficient to respond to your RFE. Didn't your RFE notice state that? If it didn't then you can only respond with one of the options they gave you in the RFE notice. If you have a lawyer he/she should be able to provide you with a draft of the letter. My lawyer did tell me that alot of companies do not like to send out their tax returns.
