All,

After a long , long process, I found out online this evening that my case was approved by NSC.

Here is the time frame

December 1992: applied for asylum
December 1997: granted asylum by an immigration judge
February 1999: filed for adjustment of status
October 2003: fingerprint notice
January 22, 2004: received a lengthy RFE asking for a new medical exam, proof of one year presence and the dreaded I-602 waiver form (visa intent issues).

February 24, 2004: NSC received the RFE. I hired a lawyer to prepare the I-602 and its supporting documents (96 pages).

February 27, 2004: APPROVED!!!! This is record time by INS standards!.

I would be happy to answer any questions you guys might have.

Good luck to all!

As far as the I-602 goes, check the old posts. It has been talked about a number of times.

They wanted proof of one year presence after the grant of asylum and before I-485 submission. I sent them mortgage payment records, credit card statements and utility bills.

Good news for all of us still waiting.

Congratulations and good luck.

Dear Rik-tik-tak,

I thought you had your adjustment granted last summer. So what you still waiting for?

I have the same question. You wrote a number of times that you were approved.

I think he is talking about waiting for plastic card ...but again that is my assumption..

I don`t blame rik-tik-tak i also get flashes sometimes thinking that i have been approved.

I just took the trouble of re-reading his posts. I believe he refers to a family member with a December 99 receipt day.

Am I right?

I am sorry about all this. My job kept me busy, and I posted before so assumed everyone knows it.

I was appoved in August, 2003 and received the plastic CG in November, 2003. I am so happy about it.

However, my wife and my son,who came with approved petition for relatives, filed in December 1999, passed the fingerprints in August 2003, but still waiting. I was refering to them. It's waiting for me as well asa mostly I check the progress of the case and wait as well. I am sorry about the confusion my previous message caused. I wasn't very clear.

BTW my wife also won the DV-2004, so we applied as well. She is on interview next Tuesday. We applied in February, received notice of action two weks latter, fingerprint two weeks + one day latter and interview appointment three weeks latter. Very impressive.

If FBI & CIA cleared her background checks, she can get AOS stamp right away (the visa number is available since November, 2003).

Hope that info helps someone, who is asking - Can I apply for DV since waiting on AOS as asylee? if you have been in legal status all the time, was admitted legaly - then yes, you can...

Cheers
