Guys,

I made status enquiry through the senator. The liaison replied that our cases are assigned to an officer. We are travelling to India next week on AP. If our cases are approved the day before our travel date can we still travel on AP?

Thanks in advance!

Yes if you have valid AP then you can travel. If NO AP you cannot travel and will be in trouble if GC gets approved without AP. I think you will go through some process called Deferred inspection at POE. Check with others allso before doing anything.

Won't be any trouble if you have valid visa - H/L etc.

Hi,
I have a similar question. My 485 ND is Aug,2003 . My wife (secondary applicant) has gone to India (with AP) and I am planning to go to India next month too. Looking at the sporadic approvals from Vermont, say if I get the 485 Approval before my departure, what will be my options ? Can I get my Passport stamped and my wife can do her stamping later on ?
Anybody with any such prior experience in the Board ?

Thanks

my friend got GC approval recently and attorney told him NOT TO travel until passport is stamped. He did not have an AP but he got an valid H1b.

Read the original question (which could be quite different from your friend's case). If the case get approved 1 or 2 days before travel date, the beneficary probably won't be aware of the approval before departure. There is no reason the POE officer will deny re-reentry or panalize some other way for this kind of cases.

While you are out of the US if you I-485 approved you will go through process called Deferred inspection at POE if you have valid AP, But my question is if your case denied and you wana come back to appeal the case, can you???
