I Work for Company 'X' on their sponsored H1 Visa and am working in US for more than a year. I have decided to move to company 'Y" ,who has initiated my H1 transfer process and in this regard I have already submitted all the relevant papers to Company 'Y' for them to proceed further with INS.
In the meanwhile, my company 'X" has asked me to go back to india on a 6 months assignment by this weekend. Yet to recieve my H1 transfer notification from INS and as well as from company 'Y'.
1. While my H1 transfer in process, can I leave the country?
2. If so then do I need to go for the H1 stamping (with the new transfer - once I recieve that) again ?
3. My current employer doesn't have any plans of sending me to US on the existing H1 for the next 6 months, though I have a valid H1 stamping till 2008.
4. Please guide me as to how should I come back to US with the new transfer / new stamping / old stamping ?
