I am an H1b visa holder (f1-opt-h1b) working in the US for the past 2 years. I am getting married in late April and plan to bring my wife to the US on a h4 visa. We plan to apply for her H4 visa around end of April and travel back to the US in the first week of may.
In the meantime..her current employer in India (large global IT firm) is willing to sponsor her h1B visa if she wants them to. In that case they would apply for her h1b when the cap opens in april 2007. Premium processing is also an option.
My concern is...
1) will there be an issue if her company submits h1b paperwork in april 2007..while in the meantime then she goes for a h4 visa stamping in april end?
2) assumign the h4 visa is stamped ok... is there a possibility of problem at the port of entry due to the fact that she has a h4 visa but her h1b paperwork is going on/probably h1b approval is also received via premium processing???
I have seen on this forum several such cases (people getting h4 visa stamped while their h1b approval comes through in the meantime...so they just enter using the h4 visa..and then travel to canada/mexico to get the h1b stamp with the h1b approval in order to get the h1b I-94). I understand that bit..but i just dont know whether the steps outlined in 1) and 2) above are 'illegal' or just have some small element of risk involved..the worst case being just some additional questions being asked at the consulate, port of entry.
