Applying OCI Infant Only - Newyork Consulate

Hi,

I am applying for an OCI for my kid.

Me and my wife both have OCI. My indian passport was cancelled last year and so I do not have
Surrender Certificate. My wife has surrender certificate.

My question is should I need to apply for SC before applying OCI to my kid or SC is not required in this case?

Any suggestions welcome please

My opinion is that it should not be required but these CGI people are real idiots and could possibly cause issues with that. Why don't you let your wife apply for your child's OCI and that way, if a SC is really needed, she can attach a copy of hers?

Excellent suggestion. OP mentioned infant, the BC of a child will have both parent's name. Do check if the US Passport is valid for 5 or 10 years.
 
I think also you should be ok because you did get your passport canceled last year before any of this SC nonsense began. I think your canceled passport is probably stamped with something saying that passport canceled due to acquiring foreign citizenship or something like that, right? I heard that people whose former Indian passports were canceled with that particular stamp do not need to apply for SC. Either way, let your wife apply and be done with any potential issues by attaching copies of her SC.

Chicago Consulate verbiage

Please note that if you have acquired US (foreign) Citizenship on or before 31 May 2010 and if you have "Cancelled" stamp on your Indian passport, then there is a no requirement of acquiring "Surrender Certificate". If you do not have a cancelled stamp on Indian passport then you need to get the "Surrender Certificate". However fees for that is US$ 20 only.

However US (foreign) citizens of Indian origin who naturalized on or after 1 June 2010, they have to follow the above-mentioned procedure with requisite fees of US$ 175/- for "Renunciation and Surrender Certificate".

Why what's wrong with your wide applying alone ? She's applying for herself, and she's an adult. What is the problem you anticipate ?

Either one can sign the Part B under the section "Application for Minor's". Make sure you attach all required copies of documents required as proof of eligibility.
