Applying now for I140

Hi,
I am applying now today or tommorow for I140 with CP option. Good that my company is not processing parallel thats why I opted for CP option...

What will happen if your company - God forbid - Lay you off!!! If you have few years remaining on H1 you are fine. If 140 approval takes 1 year and CP takes 4-6 months and your H1 is getting over soon, you are taking a big risk.

EAD will protect you legal status atleast help you to survive!!!!!

You are falling into trap of your employer!!!

The total time to attend the safe legal status is 9-12 months for approval for I140 and 6 months if we go through I485 route. In that time I will get a GC in hand through the CP route, where as through regular process I can only be safe.

Initially opted for CP.....

When i filed my 140, i opted for CP option and after 3 months, the concurrent rule came into effect. While filing the 485, we clearly indicated that we don't want to continue with CP option. Companies are ready to hire people with EAD. Had I been without EAD, i can't think of AC-21!
With the present market situations and the INS backlogs, i feel concurrent filing is better than CP because of the portability facility. I have seen situations where AC-21 is coming as a big relief for candidates who are exploited badly by their employers...

Well you are lucky that your company is filing simultaneously, thats not true for me so CP is the better option. Also I dont know whether it is legal to change the job by just having EAD if you have not finished 6 months in your I485 stage with a approved I140. If it is legal then the AC-21 rule does not make any sense!

I-485 is your petition, not your employer's, and you can file 'concurrently' by sending in your I-485/I-765 etc with the I-140 notice, when you get it. This is assuming that the employer will give you an employment letter
