Applying for USC while spouse out of status

Hi all,

I am a GC holder and will be starting the USC process next month, however I am concerned because my wife is currently out of status (overstay). I am worried that if in the application I claim to be married and my spouse is out of status, my USC will be denied.

I would like to hear from you who were in the same position or has some knowledge about this matter to give me some insight on how I should proceed on this.

Thanks!

The behavior and status of other adults have no impact on your application, which will be based on yours. However, since you have to tell the truth, you could actually be helping the CIS catch her and deport her. In practice, they will look the other way as you can always sponsor her right after naturalization (with no wait and no penalty), and deportation proceedings would likely take longer than your naturalization.

Claim the truth my friend , lying under OATH during you interview can get you deported  especcialy for something that can be verified in a minute or less .
During your interview make sure you take your marriage certificate with you
