I am on a H1(B) visa and am currently in the seventh year of my visa. I have gotten the 3 year extension of my visa after the 6 year H1 cap since my I-140 is approved. In case I decide on marrying a person who is on F-1 visa who is likely to be on this visa for an extended period of time, I would like to know:
(a) if I can apply AOS for my spouse if she is on F-1 visa? My understanding is that my spouse (on F-1 visa) can apply for AOS as long as she has not entered the US on F-1 status less than 61 days before filing AOS nor can she have applied for OPT EAD less than 61 days before filing nor can she have a new I-20 issued within the 61 day mark. Is this correct? Any other caveats I should know about?
(b) Are there any issues/limitations on my spouse continuing her studies on the EAD/AP received through AOS filing?
(c) the implications of applying for AOS for myself, when eligible.
