Applying for I-485 when I-140 is pending

Can one apply for 485 If he/she already applied I-140 and is in pending status(Provided the 485 priority date is current)?
Please let me know your suggestions or situations that you acrosss similar to this

I am in the same boat like u.... after going through this forum and other articles,
I feel as the concurrent filing of 140/485 is not ruled out yet, we can go ahead with 485.



I am just one of u not a lawyer.

The problem with concurrent filing is , a huge file

An immigration attorney was online chat at www.expatsvoice.org tonight and a simular question came up

Is it better to concurrently file I 140 and I 485 or do separately

The answer was separately

The USCIS make mistakes, separates files, paperwork goes missing.

So he said it is better to file I 140 only, once approved then file I 485


The other point was, if an immigration officer has a small file to work on or a hiuge file to work on, which one is he likely to pick up and adjust?

No issues. I filed my I-140 alone and one month later filed I-485.

They won't touch your 485 till 140 is approved. If I-140 gets rejected 485 automatically gets rejected.

I took the risk because I am Eb-2 india and gates were closing for me on August 1.

Does any one know.... do I have to attach the original I140 approval notice with 485 application?

Well my case is..... present I140 is pending.. and going ahead with 485 application. My Priority date is current based on my previous employers approved I140 (but company closed before applying 485).

So as a proof of PD based on prior I140... do I have to submit the original of approved 140?

As there no way to find out if that I140 is revoked or still good... company closed, lawyer moved... but good thing is I have original I140 approved letter.
I would appreciate if someone let me know how to know the validity of approved I140.
