Applying for I-140 without Labor hard copy

Hi:

My Labor was approved from DBEC 2 months back and my lawyer has not received the hard copy of approval. Is there any way I can file I-140 without the attorney copy of the approval of the labor?

You can file for I-140 under regular processing with request for duplicate certified copy from USCIS. You cannot do premium processing without the original. But if you receive the hard copy once you apply for I-140, you can always upgrade to premium.

I am in the same situation. Labor was approved october last year but never received the hard copy. Applied for I-140 with the request for duplicate copy.

I am also in the same situation. My Labor was ceritifed in November 2006, but have not received the hard copy. My attorney is going to file I-140 in regular along with the request for the duplicate LC papers.

Hope & Pray it goes through fine. :confused:

Just to understand this a little better:
I have to request the duplicate copy from USCIS concurrently when I file for I-140?

That is right. Attorney is submitting the copy of email notice received for Labor Certification, along with the request for duplicate LC copy. Attorney says USCIS will contact Labor dept directly to clarify.

same case

I am also in the same boat, lawyer will file I-140 without labor hard copy. Does anyone know how long it takes to get the I-140 approval with this route. I am anticipating 6-8 months as USCIS contacts DOL and everyone knows how fast things move.
