Applying for H1B while decision is pending......

I am in OPT right now, I filed for asylum and received NOID, again filed a rebuttal and since then haven't heard from USCIS yet. NO FINAL DENIAL YET, which means my OPt is Still pending
Meanwhile I am applying for H1 this April before my OPT expires.
Would there be a conflict if i file a H1 before i hear from USCIS regarding my decision?
 
Hello,
i applied for asylum after i graduated within the opt grace period, my case is still pending? what will be my immigration visa status? can i now apply for H1b?
