Applying for GC thru university... possible?

Hey people,

I'm a citizen of India, and have a bachelors from a top-3 university in the US.

I can summarize my work since 2002 when i joined my bachelors:

part-time RA work for 2 years
a 3-month internship
2.5 year full-time work.

So, i'm guessing if the lawyer can stretch it, its gonna be 3.5 years of work experience. But, I graduated in August 05, so experience after my bachelors is about 1.5 years. Does this matter? Will i be able to count 3.5yrs as experience?

I know i'll be under EB3. So, i have to be prepared for the 5+ year wait due to retrogression I guess. Therefore I dont want to apply thru my current company even though its a great job and all. I'm just not prepared to stay here for more than 2 years.

Therefore, I spoke to my prof at my univ, and he said he doesn't mind doing whatever is needed for me to apply for my GC thru him, but I will have to figure all the logistics. Finding a lawyer, requesting papers, etc.. I'm fine by this since it will give me a lot of freedom in terms of job switches.

Does anyone know if this is a feasible idea? Would it be possible to do this legally? The good thing about this is, I can count my 1.5 yrs experience at my current company when I apply thru the univ.

I have an H1B since Oct 06. I worked under OPT before that.

Really appreciate the help!
thanks!

Hello,

I had a case of them not accepting my pre-graduation experience. Unless someone else corrects me, think as though you have 1.5 years of experience...

In order for you to qualify for EB2, you either need to have a Master's degree, or 5 years of post-graduate experience. On top of that, the position you are applying for needs to have these as requirements for the position, increasing their prevailing wage and such.

So before you go for your new employer, make sure you have either one of those if you want to qualify for EB2.

I personally have never heard that you can apply for GC through a professor in university. Can you please give me some more detail!! Thanks

Hey,

Immigraboy:
Thanks for the reply, but i'm more interested on the process rather than the filing category. I am ok with applying under EB3. But, how does it work when you are not working for the university when they apply for the GC?

Will it be possible to apply under EB3, even though i don't work for them now.. what kind fo documents would I require from them, etc..

unsure:
A university is just a 'not-for-profit' company. They have the same process as other companies for applying GC's and such...

thanks.

Search for tech2468 posts. I think he is applying through University. But, he works there I think. EB2 OR(outstanding researcher) or something.

You have to be faculty in the university, otherwise they are not doing GC for you - at least the one I work for doesn't. I had a LONG conversation with the International Office about that.
