Applying for fresh L1/H1 while current L1 is under Extension

My current L1B Visa - I94 is under extension and still waiting on the response from INS and received RFE.

Now can my employer apply fresh L1 or H1-B for me while my present I-94 is under extension and I am in USA?

Which one (L1/H1B) will be faster?
