Hello
I am planning to apply for fiance visa in february. I have few questions if someone can help -
a) I don't have any income right now but can I still give affidavit of support or can somebody else totally give the affidavit of support or can jointly give affidavit of support with me
b) Is affidavit of support based on the current income or tax returns ?
c) At what stage of the process or after how much time approximately the affidavit of support is required?
d) Is it necessary for me to stay in US after I file petition for my fiance or I can go to India and live there ?. How long I can stay in India ?. Can I do the complete processing from India while staying there

Thanks

1) You can get a joint sponsor in order to meet the income requirements. The sponsor must be either another USC or a green card holder.

2) You need to submit current tax returns, though Im assuming that a letter from an employer would be the clarifying document for the income level of whom ever signs the affidavit of support (and/or joint sponsor) (this was the document that was used for our I-134). Im not sure how the whole American tax thing works...so Im not entirely sure what was the main income confirmation factor that USCIS used.

3) The I-134 will be presented personally when your fiance attends the consulate for her interview.

4) You can live overseas while the process is taking place. Just make sure that you have a valid US address where USCIS can send you the required documents, and have someone who will be able to forward these to you in India.
