Could anyone tell me if this is legal.

1. My employer in the US applies for a H1B petition in April.
2. Regardless of the status of the H1B petition (ie even if the H1B petition is approved or is pending approval), can I apply for a F2 visa in July and travel to the US on an F2 visa.
