Hi!,

I got my GC in 2007 but I have been going out to my country for my education. I have been out for 11 months twice and 22 months once (reentry permit). I have gone only to complete my bachelors and masters. Now I am here for the last 14 months and working with one of the top 5 IT companies of US. I am planning to apply for citizenship as It's been almost 6.5 years since I got my GC. My continuity was broken but I had gone only for my education. I have all the documents to prove it. Will there be any issues ? I was also reading Act 316 if that can help.

Please advise.

Thanks!

I'm by no means an expert but I don't think it matters that you went back to your country to earn your degrees. I believe that you will qualify to apply for citizenship 4years and 1day after you returned to the US after getting the Masters.

You can apply 4 months and 1 day after the end of your last long trip outside the US. 2 years and 1 day if you complete 3 years of marriage to a US citizen.

Thanks all for replying.

Are there any exceptions ?

Actually I am getting married at the end of this year in my country. I am on GC and i believe that it would take atleast 3 years before my spouse could get her GC.

Are there any other options or visas etc. that I can apply for and get my spouse here after marriage ?

Thanks for all your help!!

again you ll be breaking the 4 years +1 day rule if you go in your country to get married..
Simply keep in mind the 5 years rules after your last return (your studies) to USA...

its not an issue per say, but it has a consequence. 5 years instead of 4 years+1 day if you travel again.
