My mother is here on a visitor's visa (B1) and we are planning to start AOS to initiate the GC process. We will concurrently file the Advance parole in case the process takes more than 6 months. If it does take more than 6 months, should she still have to leave the country so she is not out of status.? If she does leave the country, would there be any issue with her entering the country. I understand that you are expected to be out of the US for atleast 6 months before you re-enter US.
Instead, if we apply for a visa extension during the last few weeks of her 6-month period, would that be a better option.?
