Applying for 485 & H1/H4 revalidations..Pl. Respond..

Hi all gurus here..

I am expecting my 140 be approved end of july. Now my H1 and wifes h4 stamping was thru feb 2000. I got my h1 exntended thru end of 2003 but dont have it stamped/revalidated yet. But now i have new i94.

But at the same time my wife\'s new h4-h1 was in pipeline and she got her
H1 in April 2001. Again her passport has stamping valid thru feb 2000. But she has h1 thru end of 2003. so as new valid i 94. As hers is status change h4-h1 i have to go to india to revalidate it. And there is no possiblity of us going to india to do that in near future and i am hoppinng to apply for 485 in next 2-3 months. Will it create any problems for her ? Does passport has to be revalidated and stamped at the time of applying for i-485 ?..

Pl. help and provide your comments and guidance...thanks a lot

I am not a lawyer,so it\'s advisable to get a legal opinion. AFAIK,you don\'t need to get your passports revalidated UNLESS u want to travel abroad. At least NOT for I-485 filing to answer your question! However,it is recommended to have it revalidated via mail at the State Dept in Washington D.C so that you have the latest paperwork on hand. I was also in the same situation. Yaah, you can apply I-485 without getting stamp on your passport. Check question 4 on following web site
