My friend is currently on H1 and has not had any employment/pay stubs for 4 months. I wanted to know she might face problems applying for a fresh H4 Visa from India (Chennai) after returning to India. She didnt file a Change of Status as she knew that she would have to go to India for some family event, before her change of status came thru and that the COS would be invalid if she went while it was being processed. her husband has valid H1 documents.
